Preamble
These General Terms and Conditions of Sale (hereinafter the “GTC”) apply to any order placed on the website www.bobijoo.fr (hereinafter the “Website”) by a consumer within the meaning of the introductory provisions of the French Consumer Code and Directive 2011/83/EU of 25 October 2011.
The Website is published by ANGELYK, a simplified joint-stock company with a share capital of €10,000, whose registered office is located at 8 route de Civeyrac – 43100 Paulhac – France , registered with the Trade and Companies Register of Le Puy-en-Velay under number 799 983 978 (hereinafter “BOBIJOO”).
The applicable GTC are those in force on the date the order is validated. BOBIJOO reserves the right to amend them at any time.
Article 1 – Purpose and scope
The purpose of these T&Cs is to define the rights and obligations of BOBIJOO and the customer in the context of the online sale of fashion jewelry and accessories (hereinafter the “Products”).
The Customer is a natural person of legal age or having legal capacity, acting exclusively for non-professional purposes.
Any order implies full and unconditional acceptance of these T&Cs.
Article 2 – Products
The Products offered for sale are described as accurately as possible. Photographs and visuals are for illustrative purposes only and do not constitute a contractual commitment.
Offers are valid while stocks last. In the event of unavailability of a Product after an order has been placed, the Customer will be informed as soon as possible and may choose between a refund or a credit note.
The Products remain the property of BOBIJOO until full payment of the price.
Article 3 – Prices
Prices are indicated in euros, all taxes included (VAT included), excluding delivery costs, which are specified before order validation.
BOBIJOO reserves the right to modify its prices at any time. Products are invoiced on the basis of the price in force at the time of order validation.
For certain destinations, prices displayed in euros may vary depending on the applicable VAT rate and, where applicable, exchange rates when the local currency is not the euro. The final amount is displayed before final validation.
For orders shipped outside the European Union, customs duties or local taxes may be required by the competent authorities. These charges remain the sole responsibility of the Customer.
Article 4 – Order
Placing an order requires the creation or use of a customer account. The Customer undertakes to provide accurate and complete information.
Before final validation, the Customer may review the details of their order and correct any errors. Validation constitutes acceptance of the T&Cs and formation of the sales contract.
An order confirmation is sent by email. BOBIJOO reserves the right to refuse an order for legitimate reasons, particularly in the event of suspected fraud or previous payment incidents.
Article 5 – Payment
Payment is due in full at the time of ordering. Available payment methods may include:
- Credit card
- PayPal
- Apple Pay
- Amazon Pay
- Bancontact (subject to eligibility)
- Alma – installment payments (subject to conditions)
- Bank transfer
Payments are processed by secure service providers. No banking data is stored by BOBIJOO.
In the case of payment by bank transfer, the order is processed after receipt of the funds.
Article 6 – Delivery
Products are delivered to the address provided by the Customer at the time of ordering.
Orders are dispatched within a maximum of 24 business hours, except in cases of force majeure. Delivery times and costs are specified before order validation.
In the event of an abnormal delay, the Customer is invited to contact customer service via the Site’s contact form.
Article 7 – Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a legal period of 14 days from receipt of the last Product to exercise their right of withdrawal.
BOBIJOO additionally offers a “satisfied or refunded” commercial guarantee extending the total return period to 30 days.
The right of withdrawal does not apply to personalized Products or Products that cannot be returned for hygiene reasons, in accordance with Article L221-28 of the French Consumer Code.
Products must be returned in perfect condition. Return shipping costs are borne by the Customer, except in the event of an error or proven defect.
The refund will be made within a maximum of 14 days from receipt of the return or proof of shipment.
Article 8 – Personal data and GDPR
Personal data collected is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act.
The purposes, legal bases, retention periods and rights of individuals are detailed in the Privacy and Cookie Management Policy .
The Customer may exercise their rights (access, rectification, objection, deletion, limitation) via the Site’s contact form.
Article 9 – Intellectual property
All content on the Site (texts, images, visuals, logos, creations) is protected by intellectual property law.
Any unauthorized reproduction or use is strictly prohibited.
Article 10 – Liability
BOBIJOO is subject to an obligation of means. Its liability cannot be engaged in cases of force majeure or events attributable to the Customer or a third party.
BOBIJOO cannot be held liable for damage related to the use of the Internet network.
Article 11 – Applicable law and disputes
These T&Cs are governed by French law, subject to mandatory provisions of European Union law.
In the event of a dispute, an amicable solution will be sought as a priority. The Customer may use a consumer mediator free of charge or the European online dispute resolution (ODR) platform.
Article 12 – Final provisions
If one of the clauses of these T&Cs were declared null and void, the other provisions would remain fully valid.
